End User Licence Agreement (EULA)

This End User Licence Agreement ("Agreement") is a legal agreement between Wheelhaus Group Pty Ltd ATF The King Family Trust trading as Konstructed ("Konstructed", "Konstruct:ed", "we", "us", or "our") and you, the user ("you"), the individual or entity ("you" or "user") who downloads, purchases, installs, or uses the Konstruct:ed Bluebeam Tool Chest ("Licensed Tool").

By accessing, downloading, or using the Licensed Tool, you agree to be bound by the terms of this Agreement. If you do not agree, do not download or use the Licensed Tool.

1. Licence Grant

Konstruct:ed grants you a non-exclusive, non-transferable, non-sublicensable, and revocable licence to use the Licensed Tool for use solely within your business operations in Bluebeam Revu.

This licence is limited to the number of users or devices purchased and does not grant rights to share or distribute the Licensed Tool beyond the licensed individual or their organisation.

If you are licensing this tool as an individual (e.g., for personal development or training), you may only use it for your own use and must not share, distribute, or allow access to others.

2. Permitted Use

You may:

  • Import and use the Licensed Tool within your copy of Bluebeam Revu;

  • Use the Tool Chest across your internal projects or workflows;

  • Install the Tool on devices solely used by the licensed user, up to the number of devices permitted by the licence purchased. Installation on shared or unauthorised users' devices is not permitted.

  • The Licensed Tool may be installed on up to [two] personal devices used by the same licensed user, unless otherwise agreed.

3. Prohibited Use

You may not:

  • Resell, repackage, distribute, or share the Licensed Tool outside of your organisation;

  • Claim authorship, rebrand, or modify the Licensed Tool for public or commercial use;

  • Use the Tool in a way that competes with Konstruct:ed or breaches Australian IP law;

  • Reverse engineer, extract, or decompile the contents of the Licensed Tool.

4. Ownership and Intellectual Property

All intellectual property rights in the Licensed Tool are and remain the exclusive property of Konstruct:ed. This licence does not convey any rights of ownership to you. The design, structure, and contents of the Tool Chest are protected under Australian copyright and IP law.

5. Updates and Compatibility

We may release updates or improved versions of the Tool Chest. These may be made available at our discretion and may require a separate purchase unless stated otherwise.

Konstruct:ed is not responsible for incompatibility issues arising from third-party software updates (e.g., Bluebeam Revu version changes).

6. Term and Termination

This Agreement takes effect upon download or purchase and continues until terminated. We may terminate your licence immediately if you breach any term of this Agreement.

Upon termination, you must immediately cease using and delete all copies of the Licensed Tool from all devices.

7. No Warranty

The Licensed Tool is provided “as is” without any warranty, including fitness for purpose or uninterrupted use. You are responsible for ensuring compatibility with your software and systems before use.

8. Limitation of Liability

To the fullest extent permitted by law, Konstruct:ed is not liable for any indirect, incidental, special, or consequential damages arising from use or misuse of the Licensed Tool.

Our liability is limited to the amount paid for the Licensed Tool.

9. Governing Law

This Agreement is governed by the laws of Victoria, Australia. You submit to the jurisdiction of the courts of Victoria for the resolution of any disputes.

10. Amendments

We reserve the right to update or modify this Agreement at any time. Continued use of the Licensed Tool after changes indicates your acceptance of the updated terms.
